Your privacy is important to us. EverHome Mortgage Company is committed to providing you with the best service,
while respecting your privacy. In an ongoing effort to provide you with enhanced financial services, EverHome
Mortgage Company works with its affiliates and nonaffiliated third parties to provide you with products and
services that will assist you in meeting your home ownership and financial goals. In order to accomplish this
goal, we may share information about you with our affiliates or nonaffiliated third parties. This Privacy
Policy (“Policy”) describes the standards we follow in handling information about you and your loan. We will
send you a copy of this Policy annually. We will also send you any changes to the Policy.
What information do we have?
We collect nonpublic personal information about you from sources like:
- Your loan application and other forms.This includes information about your age, gender, marital
status, number of dependants, assets, debts, income, employment information, address and the address of
the property securing your loan.
- Your transactions with us, our affiliates, or others.This may include:
- the appraised value of the property securing your loan;
- the dollar amounts, payment due dates, payment record, and status of your property taxes, homeowner’s and flood insurance premiums;
- your loan balance, payment amount, payment history, and charge-offs;
- and information you give to us in any telephone call, letter, or e-mail to us.
- Reports from consumer credit reporting agencies.This includes information about your credit
worthiness, financial circumstances, and credit history, including any bankruptcies or foreclosures.
How do we protect your information?
Protecting your information is important to us. We have policies, procedures, employee training, and
communication programs in place to protect your information. Examples of how we protect your information
include, but are not limited to, the following:
- Restricting physical or other access to your nonpublic personal information to persons with a
legitimate business need to know the information in order to process or service your loan;
- Contractually requiring third parties doing business with us to comply with all privacy and security laws;
- Maintaining physical, electronic, and procedural safeguards that comply with federal standards to guard your
nonpublic personal information.
You can help us to protect your information by keeping your loan number confidential.
Do we disclose your information to nonaffiliated third parties?
We may disclose all of the information about you, as described above, to certain people, subject to legal
restrictions, and subject to your right to ask us not to share your information. Your right to ask us not
to disclose your information is referred to as your “Opt-Out Rights” and is more fully described below.
To what nonaffiliated parties do we disclose your information?
Subject to your Opt-Out Rights described below, we may disclose your nonpublic personal information
to the following types of third parties:
- Financial service providers, such as banks, mortgage companies, mortgage brokers, consumer
credit companies, investment advisors, and similar companies;
- Insurance providers, such as life insurance companies, credit insurance companies, hazard
insurance companies, automobile insurance companies; and
- Other optional service providers and organizations.
Even if you opt-out of information sharing, we will still share information about you with certain
third parties as permitted by law or regulation. This may include, but is not limited to, disclosing information:
- To parties assisting in the servicing or processing of your loan;
- To our lawyers, accountants, auditors, regulators, and advisors;
- To protect our rights relating to, and the security of, your loan, our website, or our
telephone customer service center;
- To verify the existence or status of your loan for a third party;
- To companies that perform marketing services on our behalf, or jointly with us;
- To other financial institutions with whom we have joint marketing agreements; and
- When you ask or give us permission to do so.
Do we share your information with our affiliates?
We are affiliated with several types of companies, including but not limited to other financial
service providers, such as banks, mortgage companies, and title insurance agents. Even if you
exercise your Opt-Out Rights, we may share with our affiliates information about our direct
transactions and experiences with you.
Subject to your Opt-Out Rights, we may share information about you obtained from third parties
with our affiliates, including:
- Information from your application, such as your age, gender, marital status, number of
dependants, assets, debts, income, employment information, address and the address of the
property securing your loan;
- Information from a consumer report, including information about your credit worthiness,
financial circumstances, and credit history, including any bankruptcies or foreclosures;
- Information to verify representations made by you, such as verification of your income,
employment, and open lines of credit with others; and
- Information from a person about his or her employment, credit, or other relationship
with you, such as your employment history with your employer, or credit history with
another financial institution.
Do we share information about our former customers?
We do not disclose nonpublic personal information about our former customers, except as permitted
by law or regulation.
How can you Opt-Out?
If you do not want us to disclose nonpublic personal information about you to nonaffiliated third
parties, or if you want to limit the nonpublic personal information we may disclose to our
affiliates, you may Opt-Out. You may exercise your Opt-Out Rights by completing the form below
and mailing it to: EverHome Mortgage Company, Attn: Information Sharing, P.O. Box 2109,
Jacksonville, FL 32232-9987. You may also exercise your Opt-Out Rights by calling us as
1-800-669-9721. In the case of joint account holders, an opt-out by one account holder will be
effective as to all account holders. Please remember that even if you choose to opt-out, we
will still disclose information about you as permitted by law or regulation.
